ITAR compliance software: Why firms need the right tools

ITAR stands for International Traffic in Arms Regulations and is a US federal regulation related to the import and export of defense-related products listed on the United States Munitions List (USML). The purpose of the rules is to restrict the export of such goods and services to entities that could harm US national security.

Unlike the similar EAR export control rules, which cover 'dual-use items' with both civilian and military applications, ITAR focuses only on military-specific items, services and technical data. As such, it is one of the toughest sets of rules enforced by the US government. 

Rules governing this area can be complex and the penalties for failing are high, so having the right technology such as ITAR compliance software is highly valuable.

ITAR rules do not only apply to manufacturers. Any company that handles, manufactures, designs, sells or distributes items on the USML must be compliant. This can include:

• Wholesalers
• Distributors
• Software and hardware vendors
• Third-party suppliers
• Contractors
• Brokers

Any company engaged in activities covered by ITAR compliance is required to register annually with the US State Department's Directorate of Defense Trade Controls (DDTC). As of 2026, the registration fee is $3,000 for first-time registrants (Tier 1). For renewals, the fee is typically $4,000 (Tier 2), though it can increase significantly for firms with high volumes of favorable determinations (license approvals). Renewals must be made 30-60 days prior to expiration to avoid a lapse in compliance.

The USML itself covers 21 categories of controlled items, ranging from firearms and ammunition to missiles, aircraft, chemicals, spacecraft, directed energy weapons and associated technical data. The full list of categories can be found here.

Companies do not need to be large defense firms to fall under ITAR jurisdiction. Small suppliers, subcontractors and software developers working anywhere in a defense supply chain may all have obligations they need to meet. All companies in the supply chain of an item on the USML must be compliant, even if they are not directly responsible for exporting or selling items to a foreign buyer.

Achieving and maintaining ITAR compliance is a complex challenge for many businesses, with key issues that must be addressed including:

• Supply chain complexity: Defense supply chains often involve multiple tiers of subcontractors and suppliers, each of which may handle controlled technical data or components, creating significant oversight demands.
• Regulatory change: ITAR rules are updated regularly, requiring compliance teams to monitor and implement changes to the USML and DDTC guidance on an ongoing basis.
• Foreign national access: Controlling who can access ITAR-controlled data, including employees, contractors and cloud systems, requires robust access management processes.
• Recordkeeping: Firms must maintain detailed documentation of licenses, exemptions and transactions for a minimum of five years.
• Training requirements: All relevant staff must receive regular, role-appropriate training and businesses must document completion.

Non-compliance carries serious consequences with both civil and criminal penalties. Criminal fines can be up to $1 million and up to 20 years' imprisonment, while businesses may face debarment from future government contracts.
